Auto Insurance Claims/rear-ended on an icy road

Question
I was rear-ended on my way to work early this week in Columbus.  The road was icy and I started to lose control of my car so I tried to pull over to the curb.  My car slided a little and finally came to a complete stop at an angle (about 45 degree) and half way blocking the road.  I was catching my breath and all of a sudden a guy hit me from behind.

We both drove to a police station.  He told the police officer that his car was out of control and the road was icy.  My trunk is smashed and the two panels next to my trunk is fine.

I was in shock the first day and my right shoulder started to hurt the next day.  I went to a hospital to get it checked out.  I got a shot and some pills to take home.  A day later, my right arm and fingers experiment numbness and tingling.

The guy's insurance company want me to give a recorded statement and also implied that I was 50% at fault.

My question is, 1) Should I get a lawyer? 2)  How likely that I'll get my medical bill paid and my car fixed?  3) How likely will a person need physical therapy treatment for soft tissue injuries for tingling and sore on the right upper extremity?  Thank you.

Hi Joli,

The injuries you describe sound like the typical injuries you would expect from a rear end collision. You should seek what ever treatmnent may be necessary to get relief.

The other drivers insurance is trying to place 50% of the blame on you. If you let this happen then you will only get 50% of your car repair cost and 50% of your medical bills. You may want to speak with an attorney before you give any statement or agree to any percentage.
