Auto Insurance Claims/Auto PIP claim

Question
Hello Anne,
I was hit in August by a driver at fault and have used my PIP to cover the medical expenses for the shoulder sprained muscles. My care is completed and all bills sent to my own PIP provider as well as the driver at fault insurance.
Two questions: Do I receive anything from my PIP coverage of 5k what my bills didn't require? (Looks like 1500.00 used)
Second: The adjuster for the at-fault driver called repeatedly to "warn" me that they would only pay for two doctor visits when my doctor said ten was necessary. It caused a lot of internal worry about the way they would handle my claim, but calls stopped when an external audit was done on how I liked "xyz" company after they repaired my car and I reported that I would never recommend any driver to "xyz" because of the harrassment I had received from early on regarding the simple injury. How do I get reimbursement on use of my PIP from this company? The doctor office has kindly faxed all notes/bills to this company and I wait to hear. (am in Texas if that applies)

Hello Tori,

You would not paid for the difference of what your PIP and the limit (5K). Special damages (medical bills, for example) are paid in a dollar per dollar basis. Please see:

Second:

PIP pays the medical providers first. Then your insurance company takes the payments and subrogates directly from the at fault insurance company and they settle the matter that way. If they disagree over the amount, they go to arbitration over it. Most of the time, however, they agree and pay each other. None of this money comes to you.
