Question
I was hit by a semi truck and he kept going. My insurance company wants to total out my van at a very low value. Do I have to take what they are offering? The van was still drivable and they say I can not keep it since I still owe on it.

Answer
You have to negotiate your total loss. Try to increase the value of the settlement by getting better comps. See:

Also, talk to you lender to have a total write off. Some lenders will work with you.
