Auto Insurance Claims/Pedestrian hit by car

2 months ago, my wife was hit by car turning right at 5 miles/hr when she was crossing the street as pedestrian. She fell on hood and than on road. The driver was deemed to be 100% at fault and she was taken to ER. Xray of left knee and ankle where she was complaining of pain were normal. She was discharged from ER and had 15 days of continued pain. I sent the medical bills directly to insurance company of the other guy and they paid the bills. I did not had car, so no auto insurance at that time. She was unemployed at that time, but studying for her exam and was delayed in her test due to pain. This could make her wait to enter the school for one year as she missed the deadlines. They are offering 5000 dollars for pain and suffering right now. I haven't talked to attorney yet. Her medical bills were 3000 dollars. We haven't seen the Physical therapy or taken any further treatment. She sometimes complains of discomfort at that area. Can you please tell me if this amount is appropriate to sign off in this setting?? Thank you so much!

There is no correct answer here. It really depends on what the medical bills and record say about the injury. Is she going to get better? Is this permanent at all? If yes, then you may be looking at a substantially higher settlement.

It's very wise to talk to a lawyer here. The time away from school may impact the settlement. You need to check with a local attorney. Usually, the first consult is free, so you have nothing to lose.
