Auto Insurance Claims/Uninsured Passenger involved in accident

Question
I was recently a passenger in an auto accident in which the driver of the other
car was found to be at fault.  The problem I have is that I was recently taken
off my Stepfather's insurance policy after I sold my car and was going to go
on my boyfriend's policy.  I did not move out of the house of my mother and
stepfather at the time of the accident.

I am wondering who would pay for my medical expenses.  Would it be paid
for by the driver of the car I was in or by my stepfather's because I would be
a resident relative?  My stepdad called to report the accident but they stated
that I dropped out of the policy and needed to call the other insurance
company that I was suppose to sign up with but didn't.

Answer
Hello Pete,

well, this is a difficult question without looking at the policy. You should seek the advice of a coverage attorney.

Most of the time, you have coverage as a passenger of the car that was hit. If you were removed from that policy, you still may qualify as a passenger. So, you may have PIP.

The at fault party will have to pay your damages eventually, please see:

I hope this helps,
