Question
When i go to file a petition should i name the insured (that name is on all the responses from the insurance company Allstate) or name his wife who was actually driving the car? what should I expect after that? also how do i ask for a limited letter of discovery which is one of the things i expect to receive from the insurance company? Thanks

Answer
Hello Eric,

You need to talk to a lawyer. You are asking for a long narrative of what could happen and what to expect. We can only offer general advice,

Please see: http://www.auto-insurance-claim-advice.com/small-claims-court.html

You probably want to name everyone, but the main person is the driver.
Again, talk to a lawyer.

I have never heard the term "limited letter of discovery" - maybe your jurisdiction has this, but I am not aware.

Good Luck
