Auto Insurance Claims/unlicensed drivers

Question
if an unlicensed driver is hit by someone who ran a red light will the person who ran the red light still have to pay since they ran the light and hit the unsuspecting car?

Answer
Hello Andre,

The "unlicensed" issue is largely irrelevant as the license did not cause the accident. There is an issue in the area of causation.

Please see: http://www.auto-insurance-claim-advice.com/Causation.html

If your vehicle was hit and you did not have a license, that does not make you at fault. The at fault party must pay for the damages cause.

Please contact an attorney.

Good Luck
