QUESTION: I used the cheapest  rental car available and kept for 6 days.

Took 2 months for attorney to get a response from these idiots.

Can they only pay me $26.00 a day when the car cost more.

Took them 7 months to offer money.

I live in Washington DC

ANSWER: Hi Joe,

The insurance company can offer anything they want to. But you are entitled to be reimbursed for the actual cost you incurred. You need to tell your attorney to grow a pair and demand payment in full within 3 days or he will file a law suit for bad faith claim handling. Also you should fila a complaint with your state department of insurance.

QUESTION: Thanks for response---

Attorney wants to wait till we go to--Mediation or whatever before going to trial.

Can I refuse to settle on the car damages YET settle on PI.

In other words can I separate the issues?

I'm looking for another attorney---but---.

Hi Joe,

It is possible to seperate the PI from the property damage claim, however the insurance company may refuse. They will likely want you to sign a release form in exchange for payment in full.

Since you have an attorney, you should be asking these questions of the attorney. Make a list of questions and request a meeting. Then get all of your questions answered.
