Hello, I'm was in a hit and run with a stolen vehicle. The vehicle went into my lane and side swiped me. I don't have collision so I'm being told the other insurance company will not pay and mine will not pay either. I do have comprehensive though, what are my chances of arguing that the person that hit me was intending to do it and therefore it would be considered as vandalism?

Answer
It is unusual to have no collision coverage, but to have comprehensive coverage. However, the argument that the other party damaged your car on purpose will be very hard to get by your company's claims office. Your best bet is to seek recovery of the cost of repair from the party that was driving the stolen vehicle. That is, if he has anything to take. You can file claim in a small claims court against him.
