Question
5 years ago  i was #2 in a 4 car small pile up.#1  has sued #4 and settled.  now she is suing me and #3.  this has been going on 5 years.  she has refused all offers.  now we are going to trial in 3 weeks.  can she take my house and assets if  she is awarded  more than my insurance coverage?   I was told no  but i still worry

Hello Shelly,

Well, she could (anything is possible), but it is unlikely.

Your insurance company has a duty to settle and they will likely settle for policy limits and get a release of your claim for the remainder right before trial.If this is not the case, the excess could still be owed, but then the other party might be able to go against their own uninsured motorist coverage or some other insurance there.

Your insurance company is involved and that is the best people to protect you.
