Auto Insurance Claims/Can I sue the person that hit me??

Question
About six months ago a person hit while I was crossing the street, I was taken to the hospital and to make story short i received my settlement after three months but the thing is I was supposed to get $30,000 and I only received $25,000 because that was the limit the insurance could provide me with a due to the fact that that was the premium of the insurance of the lady that hit me, So my question is: Can I sue the lady that hit me for the remainder $5000? plus another 3 months of lost wages since I already lost my Job.

Well, it depends on how you received the first $25,000. If you settled the claim and gave the insurance company a release of any and all claims, then you have already settled for $25,000 and the rest is your loss.

If you settled for $30,000 (that is what the paperwork say, that you would get $30,000 to your pocket), but somehow you only got $25,000, then clearly you are still owed $5,000. you will want to talk to a lawyer to do that.
