Hi,

My son hit a pedestrian on a bike on March 24th.  He is on my insurance.  I have $ 50,000 medical coverage and $ 25,000 liability.  From what my insurance company tells me, he was in the hospital for two weeks and needed surgery (i think hip replacement).  He is now on a rehab center.  I am afraid that my medical coverage won't be enough to cover the costs.  The man is 63 years old and is a substitute teacher.  I don't think he has insurance and he is too young for medicare.  If the bills go over the $ 50,000, am I responsible for the remainder of the costs or would he be eligible for medicaid?  He was taken to a public hospital (Elmhurst).

Hello DENISE,

I am sorry to hear about this.

Well, you can be liable for the excess above the policy limit (if the medical bills reach that). Simply because medicaid could possibly be an option, it does not discharge the debt. Medicaid could seek reimbursement directly from you and/or your son.

You want to talk to a lawyer about this. You may have "stacking" in your policy. Also, there maybe other ways to settle this so it is within the limit.
