Auto Insurance Claims/Damage to car while at Dealer

Question
The Jaguar dealer cycled the convertible top after installing a new CD player in the trunk of my car.  They said the hydraulic hoses that operate the top blew up.  Now they want an additional $1,000 to repair the hoses. Do they have liability or do I have bad luck?

Hi Jerry,

Unfortunately, there is no way for me to know if the dealer is liable or if you have bad luck.

You would need to take your vehicle to an independent expert that could inspect your car to determine if the problem was negligence on the part of the dealer or if the parts involved simply failed due to wear & tear. If they determine it was negligence on the part of the dealer they would have to document it, photograph it and be prepared to testify to it in court. Then you would demand payment from the dealership and if they refused you would have the repairs completed and sue the dealership to be reimbursed.
