Question
Ok i was in a car accident and it wasn't my fault the insurance company says they have to send me a two party check and i want to know how do i go about cashing a two party check? Or is there an alternative?

Answer
Hello Kayla,

Usually, a two party check is issued to you AND the bodyshop. The bodyshop will ask you to sign the check when they are done to fixing your vehicle and they will cash it and "get" paid from that check (usually the check covers 100% of the damages minus your deductible.

The insurance company must ensure to the lien holder that the car will be fixed. They are bound by the Lien Holder clause (sometimes referred to as the Financial Responsibility clause).

Please see: http://www.auto-insurance-claim-advice.com/Financial-Responsibility.html

If you do not have a lien holder (you don't have a car loan), you could request a check made to you.

Good Luck,
Anne
