Auto Insurance Claims/Uninsured

Question
My son did not have insurance and was recently hit by a drunk driver. His insurance cancelled due to non-payment. The drunk driver (3rd offense) took his mother's car without her knowing. He was not insured however, her car is. My son did seek medical care. Does he file the claim with his medical insurance or does her insurance pay his medical bills? Also, since he didn't have coverage, will her company pay for the damages to his car? I'm in Kansas.

Well - this is bad news. First it is very important to determine if the son had permission. Permission is not only express, but also implied. If there is no permission, then her insurance company will decline your claim (both for the car and the medical bills).

Your auto policy nay have coverage for that. Contact a local lawyer for that.
