Auto Insurance Claims/Liability

Question
I work  at a strip mall complex that has a flat roof, no ridge around the roof perimeter and has rocks covering the roof top.   A hail storm came through the area and my vehicle which was parked in a parking spot next to the building was damaged from the rocks, not the hail. I found rocks in the windshiled well. There were rocks all over the sidewalk afterwards, as well. My vehicle's damage includes paint chips and a cracked and chipped windshield.  Who is responsible?  I realize that the hail storm is considered an Act of God. However, the building does not have a ledge to keep the rocks from falling off of the edge and the rocks are loose on top of the roof.

Answer
Hi Lori,

You could try to approach the strip center owner, however, it could be said that the rocks falling were caused by the hail hitting them, so technically it it still hail damage. I think the better move is to simply file a hail claim with your insurance company so you can get your car repaired.

I hope this helps
