Hi there,

My husband was recently involved in an auto accident in which he hit another driver's car.  I recently received a letter in the mail stating that an injury claim has been filed against my husband, who is currently serving in the military away from home. The letter from our insurance company states that the individual my husband hit has retained the services of an attorney and is asking for us to release the bodily injury limits of our policy. We have a very high limit on our policy but I was wondering if this is something we should disclose to the attorney or not. I plan on sharing this information with my husband, but since our communication is currently very limited, I would like to have all the information I can get before presenting it to him. Of course I plan on forwarding this letter to him for him to sign, but I hope that we can both make a wise decision before proceeding. Thanks for your time!

Hello,

Well, you need to call your adjuster and find out if there is a possibility of the injury exceeding or even coming close to the limit. Lawyers do use this as a technique to make insureds put pressure on the insurance company to settle. However, if there is a possibility that the injury may be worth more than the limits, you do want to know this. It is important that you talk to an attorney if you believe your personal assets may be at stake.
