Dear Anne, I'm Gerardo from Argentina, on September 6th in Orlando was spending my holidays with my family in a rental car and a truck crossed in red and the car hit the passenger side destroying both vehicles. The result was my children hospitalized with cuts and bumps and my wife with a broken collarbone and pelvis. The police report and witnesses confirm that the driver committed offense in red. The driver who hit me did not seem to have insurance, but the car you rent is covered by both medical and collision. My car was rented from Alamo and had the coverage of EP (extended protection) that so little information I got at Alamo, I be covered against third parties without insurance. On the part of health insurance I dont have any problem, they are taking charge. But nobody tells me who is liable for damages, pain, suffering and the future suffering. I have to wait until the end with the insurance medical coverage or should I look for a way to start a lawsuit?. Thank you very much.

Well Gerardo,

The "rental" issue is difficult not because legally it has much significance, but because rental car companies are in the business of renting vehicle and their "coverage" / "insurance" department often time does not know what is happening.

You and your passengers are entitled to pain and suffering. You will need an attorney to deal with them. There may be a good settlement for you guys (judging by the picture only).
