Question
I asked a question regarding the Multi-Car Indiana Accident on 12/29/07 where I am 100% not liable if my insurance had to cover my bills without seeking to be reimbursed from State Farm (the liable insurer) and I was told they would have to cover my bills w/out reimbursement.  Today my insurer said they will not pay the bills unless I sign subrogation papers allowing them to take their money back from a settlement w/State Farm or get it from State Farm? Is there a specific law or statue I can reference when speaking with them. The Explanations of My Coverage do not detail the procedure for this. I am with Indiana Farm Bureau

Answer
Hi T,
Although some health insurance plans have a clause that gives them the right of recovery from your settlement for their expenditures for medical bills, I have never seen an anto policy with such a clause.
If it exists, it is required to be in the legal language of the policy you have with Indiana Farm Bureau.
If you are unable to locate such wording, please contact the Indiana Department of Insurance at their in-state wats line 1-800-622-4461 or their direct dumber 1-317-232-2395.
They have copies of every policy written be each carrier in the state and will be able to fully advise you of your policy wording.
Sincerely,
Bennie
