Auto Insurance Claims/one car accident--hit a telephone pole to avoid deer

Question
I was in a car accident on my way to work one morning by swerving to miss a deer and ended up hitting a telephone pole. The road I was traveling on was in the country and noone around, and I had no phone on me. I drove the vehicle home and caught a ride to work. I called the insurance company a couple hours later to report the claim. I have only had the current policy for 2 days w/ no past insurance for a couple months. They are giving me a hard time and I don't know what to do. Can you help?

Answer
Hi Kristopher,

Well, at least you did not have the deer come up thru the windshield, as almost happened to me.

I guess that the problem is they think the accident happened and you bought the insurance later.  That should be easy enough to disprove.

Simply make your family, friend, or co-workers witnesses as to when you told them about the accident.   Also, get your driver who gave you a ride to work to make a witness statement.  Finally, assuming the delay made you late for work, simply get proof of your late arrival at work that day.

The other resource is to call your state insurance commissioner http://www.settlementcentral.com/links.php

Get a form of the complaint online and fill it out.  DO NOT SEND IT IN to the commissioner just yet.  Instead, send it to the adjuster's supervisor as an "advance copy" in the event your claim is not honored.

Finally, if they are going to give you a bad time just qualifying for the claim, you might want to brush up on some miscellaneous auto accident free information pages.
