Question
Hi, In May 2007 my boyfriend truck was stolen.
Since then his business has folded & we are in debt to not only everyone but also the insurance company.
They did everything but accuse him of stealing his own truck. Apparently it is not possible to steal the truck. However we have heard from various mechanics that this isn't true, however despite repeated attempts to get them to reopen our case they have so far ignored all our letters even the recorded delivery ones.
Reasons for denying the claim..included..
The truck had a fuel immobilize omit. Although we have been told that these are often disconnected & since partner bought truck 2nd hand it is not a legal requirement to sell with this information.
The doors have immobilizes fitted to respond to attempts to break windows.
& the time frame of 40 mins is not enough time because the mechanics from ford state it would take 4.5 hrs & expert knowledge to steal one.
Ironically 7 others of the same make all went missing in the same area. But for us I think it is too late to do anything??
& 4 times they have tried to tell him that he has a 2nd set of keys that he has told them about, which he never had.
The other one which we know is wrong is that they have asked him to supply all the names of everyone present in a pub that witness him being in the pub???

Answer
Hello,

What you need to understand is that the truth has nothing to do with any of this.

In fact, insurance companies commonly use locksmiths under the cover of the "forensic" title to examine these vehicles.
If the locksmith states (because of his ignorance on theft methods) that the vehicle can't be stolen, you are screwed!

These experts that the insurance companies commonly use in many cases don't have a clue as to how vehicles are stolen, deflect the issue and turn the claim into "How hard is it to make a key for that specific locksmith with his limited knowledge" on auto theft methods.

Once one of these reports is submitted into the insurance claim "investigative" arm, they build a purely circumstantial case against the insured.

There are a few honest investigators in this field, however, many of these investigators are ex-cops that believe no one except for the "forensic" expert, because he comes off as the all-knowing. Then it is just a matter of the insurance expert schmoothing a judge or jury making them believe that the insured was involved in the theft.

I have walked in your shoes. I have had my credibility attacked and those that I have successfully opposed have gone out of their way to destroy me. They could not beat me in my training, background, experience or common sense methodology.

Instead, they lied (no I didn't say misrepresent) about me, used the cowardly way of sending annonymous letters to the federal government about me, tried to have me charged with federal perjury and withholding funds. They attemptted to severely injure my good name and assisted in destroying my 20-year marriage.

Yet, when I was totally exonerated of all charges based on "Annonymous Allegations" and the federal case against me was closed, there was no mention of that.

Insurance companies are more than glad to take your money for the policy, but when it comes time to pay out on a claim involved in having a so-called anti-theft system, they will spend $100,000 to defend a $20,000 claim. They will ruin your reputation, they don't care!!!!

As I keep stating: What gives the insurance companies so much credibility in these claims? The people that manufacture the vehicle don't state the vehicle can't be stolen. I am not speaking at dealership level. If they could stop theft, they would warranty against theft.

Instead, we are left believing the insurance company and in most cases a questionable expert that is using his own personal lack of knowledge construed as fact.

There is not a vehicle out there that can't be force entered or stolen!

If there was a real good attorney out there wanting to make a name for him or herself, they would sue the makers of these vehicles for fraud. They blatantly call these "anti-theft" systems when these systems do not stop theft.

I had a case against Ford in which it was stated that the Securilock was impossible to defeat. The dealers said this, the expert locksmiths said this.

On 10/10/2000, I defeated this system with one wire for a judge on video!

I supplied this process to others in my field. They made supporting videos and the consensus was that my process was valid on all Ford trucks and SUVs from 1998-2003 and probably farther, but that was only the vehicles involved in my testing.

A locksmith was not looking at this system as a thief. He was looking at it as a locksmith, someone making a key for the vehicle. The dealer mechanics went by what they wre told by Ford.

I looked at this from the perspective of an auto technician and a thief, with not only my ability to read schematics, but also with my experience in the direct repair of more than 10,000 theft recoveries. An experience, not one of these expert forensic locksmiths has working for the insurance companies. I paid my dues working on this junk!

Yet, in court, if the insured does not have me for an expert, the insured stands no chance. These goffs in my opinion are believed by the courts!

Why do you think they tried to take me out? I pose a huge threat! Together with client attorneys, we have cost insurance companies millions!!!

We have kept some innocent insureds from going to jail.

Insurance defense attorneys are very good at confusing the truth. I see this commonly. They still try to misrepresent my qualifications, stating I was disqualified to testify in a court I never appeared in!

I will be starting litigation against these firms because frankly, I am sick of lies being passed off as truth!

I also find it ironic that one of these "forensic" experts is being used on the East Coast in felony trials. A convicted drug dealer testifying against an insured. The insurance companies know of this fact, but their defense is "it happened a long time ago."

You are just one more example to the fraud and corruption in this industry if you are in fact innocent.
