Auto Theft Prevention/insurance denial because of last key used (ford fusion)

Question
my insurance company is pursuing legal repercussions because they believe that my stolen ford fusion was taken with the use of my key (last key used... I don't fully understand their reasoning).  The vehicle was found but it was burned.  I had both keys and never noticed either the one I use or the back-up one ever missing. I have since mailed the keys back to the insurance company and they state they've done forensic testing on it.  I'm frightened of this "forensic evidence" I want to believe everything will be all right because I'm innocent and have never ever been in any kind of trouble but I can't sleep because I have a court date in March and a young child to care for.  I don't know what to do.  Should I be hiring a lawyer?  Can I get a copy of the report the insurance company has? Any information you can offer me to explain what's happened to me and what I should do now is gratefully accepted.

You may or may not need a lawyer, in the event you need a lawyer, depending on the state you are in, I may be able to refer one. Your situation is a specialty. Most general attorneys will take your money, you don't get the results you hope to and they don't give refunds.

The "forensic expert" will say he can determine the last key used. I make them prove it with the attorney I am working with.

I assume when you say the insurance company is pursuing this they may be working with the DA to charge you.

Here is a fact I can prove about a totally burned Ford steering column. Magnesium burns at temperatures of 5,000 degrees f. plus. In the event a fire hose hits the burning magnesium, it explodes. The chances of the ignition lock surviving a total burn passenger compartment fire is 0-nil.

It is common for a locksmith to state since the car had an anti theft transponder system the car was impossible to steal.

What I show is that it is impossible to prove this theory. Better yet, what is the insurance compensated locksmith doing looking at a burn car? Together with an attorney in a criminal case, I crush these goof that say they can determine last key used.

All cars are different and sometimes things can be determined as to last operation, however on a Ford with a total burn in the passenger compartment, it isn't happening if I am involved.

Sure, you can get your own locksmith for an expert and you will lose.

If you have no expert, you will lose.

Not to be arrogant, I am the only game in town where you might stand a chance.

The insurance companies don't want to pay claims and the anti-theft systems are their Holy Grail!

If you have been denied, you are also on an insurance data base as to committing fraud and unless we get your name off that list, you might as well never have insurance again, because no matter who insures yo, your claim will not be honored.

I work for insurance companies as well, but if I can't prove it, I don't say it.

Most insurance experts don't care as long as they get the continued work.


As for the report, you can ask, but chances are they won't turn it over unless compelled by a court which usually requires filing a law suit against the insurance company.
