You don't have a warped head gasket... you have a warped CYLINDER HEAD.  The aluminum heads are particularly susceptible to warping after overheating.  Unfortunately, the fact that the only way they warp is overheating, and that the overflow tank is leaking leads to a very possible 'out' for the warranty company.



I'd bet that there is specific wording in the contract that covers negligence or abuse.  So, given that pair of facts, the warranty company will bail on you.



I am not against after-market warranty companies.  I personally have had claims paid by them.  They have tried to protect themselves against claims from me, but you got to know the rules and abide by them.  



I always made sure the fluids were good, including the fuel.  They dipped my tank trying to say I used bad fuel one time, but it didn't work.  Document oil changes, keep records of filter changes, and do required maintenance.  Then the aftermarket warranty companies will always pay off.



I'm sorry to tell you, in this case, it doesn't look good for you.

I can answer questions related to the BMW e30. These are the cars produced from 1984-1991 (1992 for convertable) in the United states. I am more fluent with the six cylinder models, although few things changed for the 4 cylinder cars. I know most of the problematic areas of these cars, and have found ways to fix them.
