Bankruptcy Law/EEOC Claim and Bankruptcy

Question
Several of have discrimination claims against our employer for wage, age, and sex discrimination. The company has employee liability insurance. The recently started getting evicted due to non payment of rent at several locations.
Now we hear they are going to file bankruptcy. If the EEOC finds in our favor, will we get paid if they file bankruptcy? Should we be getting an attorney. We are in Georgia and the EEOC has a great backlog of cases.

Thank you!

Answer
If your company files a chapter 11 to stay in business, you will receive a notice of filing and a proof of claim form to fill out and submit to the court.  You may want to hire an attorney to advise you on your rights, and to make sure you get the money you are entitled to.
