Question
Dear people.

I started a business (Apparel),Signed a lease with  Atlantic
LLC. for 3 years. After 5 months of struggle No result, ENDED with Closed  DOOR OCT 2004?

Business was corporation S, but unfortunately I signed personal  guarantee without having any Assets. After year Atlantic SUED corporation  and ME ? I read business doesn't need to file bankruptcy since it  doesn't have any Assests. so I filed personal bankruptcy and include Atlantc LLC.

Everything was Fine until recently after 3 yrs, a collection Agency  called and said I m still Liable for lease, even after I was discharge,  because i had not filed business bankruptcy. I faxed them my Discharge paper?

what are my options ?  please Help ? should I "still" file for business Bankruptcy ?

Answer
If you followed your state's dissolution process (liquidating the assets, paying creditors etc.) and you filed a personal bankruptcy, listing that debt in your case, they should not be able to collect from you personally.  You should contact your bankruptcy lawyer to discuss suing them for violating the discharge order if you have given them a copy, and they continue to try to collect.
