Question
We have filed 13 and paid for 21/2 years my husband lost his job due to downsizing. we didnt file on our house . Now they want to dismiss us and maybe convert us to a 7. I want to know can they make us put our house in the 7 even though we dont want to file on it ?

Answer
Hi Kelly. Your house actually was 'in' the chapter 13, but the plan said you would make direct payments on it.  With chapter 7, you can reaffirm the mortgage to keep the debt, and thereby keep the home.  You usually need to be current to reaffirm, so you want to focus on the mortgage payments.
