Question Hi I was discharged from my chapter 7 BK back in 2006, and I purchased a vehicle after the discharge, but I lost my job nine months later in I was unable to make the payments I contacted to finance company and they would not work with me on the payments so I had to let them come get the vehicle. My question can I go back and add this repossession to my dischagred BK because of financel reason
Answer no. Since the debt was incurred after the date of your previous bankruptcy case, then this is a new debt and will not be dischargeable from that old bankruptcy case. Your options are to either file chapter 13 to pay back the balance owed over the next 3-5 years, or else just work with the lender to pay the balance left after they auction off the vehicle to recoup some of the balance owed.
