Hello Sir, thank you for your time.  I am asking this because my attorney will not return calls or emails since discharge.  I converted from a chpt. 13 to a 7 and this has been discharged for several months.  I converted due to huge income loss.  I converted so I could let my house go.  My question is if the house was listed in the chpt. 13 does it automatically roll-over to a dischargable debt in chpt 7?  I never saw any paperwork for the 7.  I am now receiving the typical preforclosure, you are in default, letters.  I wasn't sure if I need to be worried.  Thank you.

Answer
If you did not sign a reaffirmation agreement after the conversion, then the debt will discharge.  As the property owner, you will receive notices of the procedures.  Companies subscribe to foreclosure reporting services, which is why you may be receiving letters.  If you are surrendering the home, you don't have to make any more payments, and the debt is discharged.
