Question
If one owns a resturant and has not paid in the federal withholding taxes on his employees for several months and closes the place and files bankruptcy will he still need to pay the taxes. Same thing goes for sales tax.

Answer
Yes, the trust fund portion of the employee payroll taxes will be assessed to the responsible officer of the corporation 100% pursuant to Internal Revenue Code 6672.   Sales taxes are usually the same, although it depends on exactly how the state law provides for the collection of the sales taxes.
