Question
i now live in pa , i lived in florida last year me and hubby and i had a couple of older mobile homes and land that we sold our daughter they where investments no leans on them we sold them in nov 2007 as my husband was not working and we where trying to pay bills and a morgage on our home i just want to claim bk not husband can i do that even thow we sold these mobile to our daughter last year will the courts take them back from her ? how long is the waiting period to sell property before you can file chapter 7 as my bill collectors are always calling thanks vivian

you may have to disclose the real estate sales.  As long as they were fair, and you spent the proceeds on necessities.. Speak with a local attorney to review the transfer rules/issues, and for them to advise you on the best time to file.  There is no specific waiting period, but the courts will look at the fairness of the deal involved.
