    Bankruptcy Law - Chapter 7

Expert: Mark J. Markus- California Bankruptcy Attorney - 10/3/2009

    Question
Mr. Markus, I had a chapter 7 bk that was closed in May of 2004 (would that be the same date of discharge?).  I had assests that paid most of the debt.  Does the 70% paid apply to chapter 7 wanting to file chapter 7 again? This time I co-signed for vehicles that were repossesed and maxed out a couple of credit cards believing my husband was going to take care of it all.  I haven't worked for a couple of years because of a disability that I currently do not get ssdi for.  I have no assests this time and no income.  Do I have any means of relief?

    Answer
At this time you can file a Chapter 13 case (assuming you're within the debt limits).  You cannot file another chapter 7 until 8 years after your last chapter 7 case was filed (you did not provide that information, so I cannot do the calculations on that).
