Bankruptcy Law - forgot to add some creditors.

Expert: Norma Duenas - California Bankruptcy Attorney - 10/29/2009

Question
my lawyer just filed my bk chapter 7 petition last week and i forgot to add 3 more creditors.  can i just tell my lawyer to add them since the bk has not been discharged or do most lawyers in general charge a fee for their time to do this?  can i just get the form from the court house and  just submit it myself?

Answer
Most lawyers will charge a small fee for amending your petition to list additional creditors. In addition their is a filing fee that you must pay for amending the petition when adding additional creditors. As long as the debts are debts incurred prior to the filing of your bankruptcy case, you should be able to list them. You should seek the assistance of your bankruptcy attorney to amend the schedules, since he is the attorney of record on your petition.
