    Bankruptcy Law - reaffirmation agreement

Expert: Mark J. Markus- California Bankruptcy Attorney - 10/26/2009

    Question
i'm filing a chapter 7 to discharge a lot of credit card debts. i have my primary home and 1 rental property co-owned by my sister.  i want to keep my home and remain a co-owner of the rental property.  does that mean i have to do a reaffirmation agreement for both properties?  do you recommend a reaffirmation agreement?

    Answer
I never recommend reaffirmation agreements, and they are unnecessary on real estate.  You should check with your attorney in whatever State you are filing for local laws that might make filing a reaffirmation agreement beneficial, but usually on real estate it is not.

See my blog article on reaffirmations at http://bklaw.com/bankruptcy-blog/2008/11/reaffirmation-agreements-in-chapter-7/
