Question
I am in the middle of a pending lawsuit against a sole proprietor who built my home. We have a pending court date. We are in the midst of attempting to settle without going to court. The latest offer is well below a reasonable offer. The builder says if we go to court and I win a judgement he will declare bankruptcy. If this were to occur would I have any chance of collecting? I am not clear on what type of bankruptcy he could file because I know his income has been high the past few years. THANKS!!

Answer
That depends on what chapter he files, what assets he has available to liquidate for the benefit of creditors, and what exemption laws are applicable to protect the assets he has.  Simply no way to answer your question without at least that basic information.
