Question
I pwn a townhouse I do not intend to keep in So Cal and filed bankruptcy myself (paralegal help)in Riverside Co. The meeting of the creditors was Nov 24, 2009 and I need to add a doctor bill incurred before filing date (Oct 14 2009)Does the court notify me when the lender B of A lifts the stay? Then what happens? Do I go to court? When they lift the stay, do I receive a 3 day notice to get out or a notice of sale? Please explain the next steps?

Answer

Riverside Bankruptcy A
Generally if you are planning to surrender the property, there is no need for you to attend the hearing on the motion to lift the stay. When you will required to move out of your home depends on where the mortgage company was when you filed for bankruptcy. Generally mortgage companies foreclosure on a property through non-judicial foreclosure. The process for non-judicial foreclosure in California involves several steps. First the mortgage company must serve you with a notice of default, then you will have a 90 day period before they will serve you with a notice of sale. The notice of sale will contain a sale date, that will be set at least 21 days out. If the mortgage company has not even started the process when you filed for bankruptcy, then when they lift the stay from the property, they will proceed with this process or resume where they left off. Depending on where you are at in the process, it can be awhile before you need to move from your townhouse. For more information visit us at http://www.socaladvocates.com
