Question
I live in CA.  My sister and I are beneficiaries of her living trust.  My mother is 95 yrs. old.  I am thinking of filing bankruptcy because I am over $100,000 in debt, along with owning a home in my name (my husband is not on deed) which is now under water.  If my mother passes away in the next 6 mos., will my creditors be entitled to the assets of her trust? She is in ok health, but you never know at her age.  Thank you for your help.

Yes, and depending on which chapter you file, it may be longer than 6 months.  (Of course it depends on how much you become entitled to receive from the Trust, and whether you have sufficient exemptions under applicable law to protect that).   To see more on exemptions please go to http://www.bklaw.com/exemptions.html
