Bankruptcy Law/CD safe with BK

Question
My aunt put my name on her CD.  I am thinking of filing BK Chpt7.  Her CD can't be closed w/o penalty till sept 09.  Is this money safe?  Or should she pay the fees and close this account with my name on it?

Answer

If she closes the CD and takes out the money, it is a transfer that would have to be disclosed on your bankruptcy papers (if it occurs within 2 years prior to your filing) and could be recoverable by the Trustee.
