Question
As of March, we are starting our second year of a 5 year combo business/personal chapter 13. We received a tax refund and really need this money for home and car repairs as well as medical bills. We have not sent a copy of the return to the trustee yet, but of course we will. How can we keep this refund? Can we send receipts as proof with the return? Thank You Carol

Answer
Whether you can keep a tax refund or not depends on the terms of your plan and the Order confirming the Plan.  In most jurisidictions if you are paying less than 100% to unsecured creditors, you are required to provide any tax refunds to the the Trustee, but again, this really depends on the terms of your plan and the Order.
