Bankruptcy Law/Spent Refund

Question
I filed chapter13 last April,I was told to turn over my tax refund but I did`t.The check came to me in the mail.Whats gonna happen now?

Answer
The trustee could file a motion to dismiss the case. You need to meet with your attorney, and see if you can bring a motion to defer the default (the tax refund money) to the end of the case. You will need to then catch up on that balance before the case is over if the court grants your motion.
