I'm thinking about filing chapter 7 alone with out my husband he has no debt i'm on disability .Will they keep our tax return next yr .We already got our return for 2008 and payed of his truck

Answer
It depends. Each state allows some exemptions for wildcard, which can be used to protect tax refunds.  Some jurisdictions take them, some do not. You should meet with a local bankruptcy attorney to discuss protecting your assets ,and to determine when best to file, and how this will effect your husband.
