Question
Filed chpt 7, list car loan as secured debt to be reaffirmed.

Found out after receiving the discharge the credit union I got the loan is not listed on the title as a secured party. (No secured party on title)


I never reaffirmed the loan with the court.

Will I still be obligated to make the payments, they are direct deposits?

I can I still keep the car?

Answer
If the credit union is not secured (which I find highly unlikely, but I'll take your word for it) then you are not obligated to make the payments and you can keep the car.  However, if in fact they are unsecured, there may be more equity in the vehicle than you have exemptions to cover, so you may need to inform the bankruptcy trustee and reopen your case to amend those figures.  You need to discuss this with your attorney.
