Question Our Chapter 13 Bankruptcy case (California) was dismissed. Within days, our house was sold to another bank. About a month later, we received a Notice to Vacate. We were not informed of a sale date, and the lienholders were not informed either. Is the notification process waived as a result of the bankruptcy being dismissed?
One of the lienholders was making arrangements to purchase the home through the mortgage company.
Answer Are you talking about the notice to foreclose, or the notice on the eviction? If the notice of sale had been published prior to filing your bankruptcy case, then the time period (21 days) ran during the pendency of your Chapter 13 case, and they can foreclose at any time after the dismissal.
