Question
I AM IN ABOUT $10,000 in debt. I owe child support and was wondering if my payments can stop , paused, or keep building my arrares. Will Ihave to continue my payments or will they stop building till I get out of bankruptcy. I live in NY and was unsure about this so Iam thinking about filling to hopefully pause my payments till I can get on my feet again. Also if I live with someone and I have renters insurance and cable under name will those be affected?

Answer
Michael,

I am not licensed in NY so the following is not to be construed as legal advice upon which you should base a decision.  I strongly suggest that you consult with a bankruptcy attorney in your jurisdiction.

Bankruptcy Attorneys often provide a free consultation and they can provide you a much better, much more comprehensive review of your situation.

That being said...almost all proceedings related to divorce or parenting continue unaffected by filing bankruptcy.   Thus your child support payments will not stop.  Neither would spousal support (aka alimony), any back support payments, etc.

However, your other bills will likely stop.  I would consult with a local attorney re: your renters insurance and cable bills.

I hope that this helps and sorry for the delayed response,
