Bankruptcy Law - Chapter 7 in Arizona

Expert: Robert Vitt - 6/19/2009

Question
I am attempting to file for chapter 7 pro se in Arizona. I received all 3 of my credit reports but it turns out that many (or most) of my old debts have been charged-off or sold to someone else. Do I file on the original debt with the original creditor or do I need to track down who now owns the debt? I have tried this with several already and I am getting nowhere. The other problem is that my credit reports do not give the entire account #s and I no longer have them. Can I use my social security# in lieu of an account # when i file with the court?

Answer
Michelle,

Do I file on the original debt with the original creditor or do I need to track down who now owns the debt?

On your paperwork (it should be Schedule F) you will put down who originally held the debt as well as the current owner/collector.

Can I use my social security# in lieu of an account # when i file with the court?

No. You MUST put your account number. It should be listed on the credit report.

I want to strongly urge you to look at Nolo.com's book on filing for Chp 7 Bankruptcy.  I have no affiliation with Nolo and I receive no compensation for endorsing their product. However, it is excellent and on the basis of your questions, I think it may make the process easier for you.

I hope this helps
