Question Thank you for taking the time to answer my question. I will be filing chapter 7 bankruptcy in Michigan. My home has a negative equity and will be surrendered in bankruptcy proceeding. When will I be required to move from the house after filing chapter 7? Thank you for your help.
Answer Richard,
After you file for Chapter 7 an automatic stay will take effect. The mortgage company will have to file a motion for relief from stay first in order to foreclose and evict you. To some extent your answer will depend upon the lender.
