Bankruptcy Law - Disabled while on Chapter 13

Expert: Terry Leeders - 6/29/2009

Question
I have been paying on a Chapter 13 bankrupty for almost 3 1/2 years, with 1 1/2 years remaining.  Social Security and the State of Idaho have just determined that I am disabled and qualify for SSI and disability, which severely limits my ability to work.  Is there any way to be excused from the Chapter 13 because of this?

Answer
You can do one of the following:
1. convert to ch7 if eligible, and you currently spend what you make on your monthly living expenses.
2. You can petition the court for a modified plan, based on any changes in income/expenses if you stop working etc.
