    Bankruptcy Law - RE Commissions

Expert: Mark J. Markus- California Bankruptcy Attorney - 6/29/2009

    Question
I am, along with perhaps 400 others, an independent contractor working for Consolidated Resorts here in Las Vegas. We were locked out last Tuesday and told that none of our real estate commissions would be paid because the company would be filing chapt 7. Are these commissions enforcable? Where do we fall on a bk judges list of creditors. To my understanding this company owes several large companies in the millions. We are are small(families) and losing 5-10 thousand dollars hurts us more than say a huge casino losing a million in unpaid rent. Can anything be done, can anyone help us?

    Answer
You have a priority claim up to $10,950 for commission earned within 180 days prior to the commencement of the chapter 7 case.  You should file a proof of claim with the bankruptcy court and then hope there are sufficient assets available after liquidation to pay part (or all) of your claim.
