    Question
    I was granted discharge from my bankruptcy on June 1, 2009. I surrendered my car and home. I was unemployed for two years and just recently found employment. I would be able to pay my 1st mortgage but not the 2nd. Before I filed, my realtor said my house would probably sell for 110-115K. My first mortgage is 170K, my 2nd 35K. Is it possible to resume my 1st mortgage and not my 2nd? I live in Virginia. Thank you.

    Answer
    If they haven't foreclosed on your home yet, of course you can resume payments, but you have to catch up on the past due amounts or enter into a modification agreement with them, or else either the first or 2nd can foreclose pursuant to the terms of the Note and Deed of Trust.
