Bankruptcy Law - reopening a chapter 7 case

Expert: Terry Leeders - 6/26/2009

Question
I filed chapter 7 bankruptcy but the bank did not send me my reaffirmation agreement before the bankruptcy was discharged.  Can I reopen the case to file the reaffirmation agreement?  I live in Indiana.

Answer
It would depend on your local court rules. Normally the reaffirmations must be in before the case is discharged.  Talk to your lawyer about the costs to bring a motion to reopen a closed case, and the likelihood of your court granting such a motion.  The creditor would also have to agree to it.
