Question
My mother is terminally ill and living with us, she has about 60k in cc debit and is on disability and receives SS. We want to declare BK chpt 7 so the money she has can be used to take care of her, can we do this?  Also she has a $24K 401K, which I hope she could keep. Dr's say she could live 9-14 months and this money is going to be needed for nurses, etc. Should I call creditors or just file.

Answer
I'm sorry to hear about your mother.   Does she have any assets?  If not, then she is basically judgment-proof and there's really no need to file a bankruptcy case for her.  Her SSI income is protected as is her 401k.  Otherwise, yes she can file a bankruptcy.  Simply contact a qualified attorney in her area and they can advise on how to proceed.
